Federal Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks lawful basis.
"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.
The case originates in a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an mistake. Following his return to the United States to answer alien smuggling allegations, he was detained in federal custody.
In her order, the judge pointed out that the government does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The court proceedings involve conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
